Who Leaked The Roe V. Wade Draft?

Violating hundreds of years of norms and ethics, a leaked memo from within the Supreme Court purports to show a majority of the nine justices having indicated a willingness to overturn the half-century-old Roe V. Wade decision. If true, the leak itself is nothing short of blatant judicial intimidation and amounts to an insurrection in its own right, according to D.C. politicians and pundits.

The leaked draft dates back to February, written by Justice Samuel Alito, strongly hints at an overturning of the flawed 1973 decision of Roe. He was joined by Justices Thomas, Kavanaugh, Gorsuch, and Coney Barrett. Unknown was where the spineless John Roberts stood.

The question looming over this breaking report is how it got to the media in the first place. It stands to reason that the leak came from one of the leftist judge’s camps. For starters, that side is the most fervent in their infanticidal ideology. Second, all three of the most hardline justices are women, only adding to the insane pressure to maintain a nationally-sanctioned, federally-funded abortion industry. While maybe not the justices themselves, surely someone in their own camp did it. A young, woke intern perhaps?

 

Megyn Kelly said as much: “The pathetic spineless leak of a draft SCOTUS opinion has the feel of something a sad little woke 20-something-year-old would do. The kind of person who thinks their personal agenda is ‘more important.’ Whoever did it should lose their law license.”

In addition to the likely leak from one of the leftist judges, there is the motivation to explore as well. In this instance, it seems the only likely conclusion vis-a-vis the intent of the leaker is to influence a change in voting outcomes. A better word for influence would be to intimidate.

Countless conservative voices filled the airwaves to attack this pathetic effort to influence a monumental court opinion.

Tomi Lahren appeared on Fox and Friends saying this:

“[This is] Absolutely an intimidation tactic and also a distraction tactic here…and I think we’re going to see the summer of 2020 reignited with protests and, dare I say, an insurrection. I know that’s a dirty word, but I think we’re going to see a lot more to come this week.”

Former Bush Press Secretary Ari Fleischer used similar language while appearing on Sean Hannity’s program:

“The Supreme Court seemed to be the last institution standing that had internal integrity. This is an insurrection against the court and it needs to be found who did it and whatever legal means can be taken against them needs to be taken.”

Meanwhile, several prominent social media accounts from journalists, pundits, and politicians echoed a mix of concern, outrage, and condemnation for the violative act of the leaking of such sensitive information.

 

Josh Hammer, Newsweek: “Probably the greatest violation of unwritten ‘norms’ in the history of the Supreme Court. And I absolutely guarantee you the leaker spent years railing against President Trump’s undermining of norms.”

David Reaboi, political commentator: “Obviously, one of the leftist judges leaked the Court memo to ignite protests and riots that would intimidate the justices. You will see this leaker be feted in the media.”

 

Sen. Marco Rubio (R-FL): “The next time you hear the far left preaching about how they are fighting to preserve our Republic’s institutions & norms remember how they leaked a Supreme Court opinion in an attempt to intimidate the justices on abortion.

SCOTUSblog: “It’s impossible to overstate the earthquake this will cause inside the Court, in terms of the destruction of trust among the Justices and staff. This leak is the gravest, most unforgivable sin.”

Jonathan Turley, Shapiro Chair of Public Interest Law at George Washington University: “The alleged leak of the opinion in Dobbs v. Jackson Women’s Health Organization is nothing short of breathtaking. It would constitute one of the greatest breaches of security in the history of the Court…The only intent of such a leak is to trigger a response from outside of the Court. This draft is from February and the majority can shift on such opinions…The most likely motivation is obviously to pressure the Court and push the legislation in Congress on a federal abortion law before the midterm elections. It will also likely renew the call for court packing.
