Federal Judge Blocks Biden’s ‘Unconstitutional’ Student Loan Forgiveness Plan
A Texas federal judge blocked President Joe Biden’s student loan forgiveness program on Thursday, calling it an “unconstitutional exercise of Congress’s legislative power.”
U.S. District Judge Mark Pittman ruled that the Department of Education’s student loan forgiveness program is illegal following a lawsuit by the Job Creators Network Foundation, which argued the program violated federal procedures because borrowers were not able to comment on the program. The student debt relief program unveiled in August would cancel $10,000 worth of student debt to those making under $125,000 per year.
In October, a federal appeals court temporarily halted the student loan forgiveness program prohibiting the Biden administration from “discharging any student loan debt.” The ruling came after Nebraska, Missouri, Arkansas, Iowa, Kansas and South Carolina sued the Biden administration for the student debt program, alleging it to be unconstitutional.
“In this case, the HEROES Act — a law to provide loan assistance to military personnel defending our nation — does not provide the executive branch clear congressional authorization to create a $400 billion student loan forgiveness program,” Pittman’s ruling said.
Despite the court’s decision, White House Press Secretary Karine Jean-Pierre said the program would “move full speed ahead.”
Borrowers have until Dec. 31 to apply for student loan forgiveness, but have been encouraged by the administration to apply before Nov. 15 to receive forgiveness before the student loan repayment pause ends.
Most of those applying for student loan forgiveness have said they would spend their extra money on traveling or eating out, according to CNBC.
The Department of Education did not immediately respond to the Daily Caller News Foundation’s request for comment.

Gives Biden the ability to say, “See, I tried, but the court wouldn’t let me do it.” It’s a con, Trump used the same excuses for why he couldn’t get stuff done. Makes you wonder whether Barr was appointed to drain the swamp, or to provide and excuse for why the swamp wasn’t drained.
Colleges have continually lowered their standards (while continually increasing costs) to pump out ultra liberal college graduates with no marketable degrees in majors like “Gender Studies” or “Climatology, or “Black or Islamic studies”. The colleges don’t care because the government now owns the student loan business so the colleges always get paid and the government gets all the interest on the loans. That’s why colleges have been increasing their tuition at an enormous rate (way above the inflation rate) for years. The indoctrinated students are angry because they can’t get jobs (except at Starbucks) but will always vote Democratic because they are promised “loan forgiveness” and, of course, Biden passed an illegal executive order to buy their votes. We all knew that it wouldn’t hold up in court but it served its purpose and probably got him a lot of votes. Except for the ever decreasing STEM majors, a higher education degree has pretty much become a scam.
Meanwhile, the real high paying six figure jobs (Plumber, Welder, Electrician) face massive shortages across the country because all those kids were getting their useless degrees instead of preparing for “real life” work. The government needs to stop all financial support of universities and remove their tax exempt status (let them stand or fall on their own), and get out of the student loan business. All the major Universities have tens of billions in endowments, yet they still get massive grants from the government paid for by us. Then the Department of Education needs to be dismantled. At this point they are just another bloated government waste of taxpayer dollars with thousands of employees and a 68 Billion dollar budget.
Of course that will never happen as this government continues its mission to destroy the American middle class and rule us by a cabal of elite Democrats and their compliant “woke” big business partners. They’ve already weaponized all the government three letter agencies (the FBI, the CIA, the IRS, and even the DOD) and the mainstream and social media against the political opposition. They promise to let the big businesses who support them keep their tax breaks and monopolies and, through our completely open border, they will get all the cheap foreign labor they could ever want. So the coup is almost complete. When they are finished there will just be two classes of people; the rich Democratic overlords in collusion with their subservient big business oligarchs and the poor masses. Just like any other Socialist/Communist state in the history of the world.
Biden’s plan for debt forgiveness on student loans was flawed to start with….From what I read they are NOT paying off their debts but rather using the money for new cars, lavish vacations etc. This bill should have stated money HAD TO GO TOWARDS PAYING OFF THEIR LOANS! Then it was selective who got the money… Biden’s continues to destroy our economy nd it seems to me not one pol;itical figure is lifting a finger to combat this including McConnell.
