Zimmerman Heads to ‘Stand Your Ground’ Trail, Could Face Acquittal

George Zimmerman still stands accused of the shooting death of 17 year old Trayvon Martin in Sanford Florida. On Thursday Zimmerman’s lawyer announced via his website that there will be a ‘stand your ground’ hearing, based on the claim that Zimmerman killed Trayvon Martin in self defense. Via Fox News and the Associated Press:

A finding in Zimmerman’s favor would end the criminal case against him, as well as immunizing him from civil action.

“Now that the State has released the majority of their discovery, the defense asserts that there is clear support for a strong claim of self-defense. Consistent with this claim of self-defense, there will be a ‘Stand Your Ground’ hearing,” said O’Mara in a statement.

The law allows people to use deadly force, rather than retreat, if they believe their lives are in danger.

O’Mara described the hearing as a “mini-trial,” with arguments, witnesses, experts and evidence that would be included in a criminal trial, but without a jury. 

Tensions continue to run high in the city of Sanford and across the nation as many believe the shooting was racially motivated.

Al Sharpton’s National Action Network has been a staunch supporter of the Martin family throughout the ordeal. At the time of this post they could not be reached for comment.

Amanda Knox Had An Angel From Idaho

When Amanda Knox steps out of the airplane and breathes American air on Tuesday, she might want to think about what she’s going to write in her "thank you" card to Greg Hampikian.  You may already know about Knox’s murder trial and subsequent acquittal in Italy, but you may not have heard about one of the men who played a pivotal role in setting Amanda Knox free.

When Dr. Greg Hampikian, a professor of forensic biology at Boise State University and director of the Idaho Innocence Project, decided to study how DNA evidence is used in other countries, he happened to stumble upon some facts that eventually led to Amanda Knox’s acquittal.

Hampikian said by chance he began looking at the DNA evidence in the Amanda Knox case two-and-a-half years ago.

"I was trying to study how DNA evidence is used in other countries, and when I looked at the data, I was appalled," said Hampikian.

The DNA evidence in question was found on a knife, the alleged murder weapon and the only piece of evidence that tied Knox to the crime.

But after a closer look, Hampikian determined the trace amounts of Knox’s DNA found on the knife were so small, they could only be tested once. His team at the Idaho Innocence Project also determined there was no blood on the weapon.

"When the DNA comes back and tells you you are wrong, you need to let those suspects go home and they should have done that four years ago," said Hampikian.    -NWCN.com

Dr. Hampikian’s observation is just one of the latest in a brave new world where we have begun to challenge the once "unquestionable results" of DNA testing.  Here’s an example he came up with that shows how people can be wrongly accused of a crime even though DNA evidence suggests they did it.

"In my lab, the team took knives from the Dollar Store. They collected coke cans from the office staff at the dean’s office, and I told them don’t change your gloves between every piece of evidence, do it between every other piece of evidence. And what happened is DNA from innocent staff people in the dean’s office got onto their gloves, got transferred to the knives, and when we swabbed the knives when we looked at those very low levels like they did in the Amanda Knox case, you start to see contamination," said Hampikian.

Dr. Greg Hampikian should be commended for his work, and Amanda Knox might think of sending him a "thank you" card.  While I hope none of us should ever have to benefit from his research, there are many people who inevitably will.

 

 

Casey Anthony, Not Guilty! Well Kinda

“If it doesn’t fit, you must acquit” seems appropriate as the news media pounces Casey Anthony’s jurors for making what they consider the wrong decision. In the court of public opinion, she is guilty! As the news media creates the newest reality star, they did not fall short on the accusations of the flaws within our judicial system.

If you were on trial, where would you fall within the realm of media scrutiny? Would you be treated as guilty until proven innocent or on the elite pedestal of innocence? Whether you were guilty or not, would you receive media protection or scrutiny? Most of us fall into the guilty until proven innocent category whereas the media treat us as a hindrance. As with Casey Anthony, a jury of her peers found her “Not Guilty” of first-degree murder. It reminds me of the media circus for OJ Simpson, Michael Jackson and Scott Peterson trials. They harped over the alleged injustices for the victims of OJ and Michael. It seemed that the spin was how the media viewed the individuals. With Scott Peterson convicted to death row, his story did not prove the flaws of our court system. So, they moved on.

Meanwhile, Hollywood figures like Roman Polanski, a 43-year old moviemaker, who was convicted of raping a 13-year old, gets a pass. In 1977, he fled the nation prior to his sentencing that could have been up to 50 years. Whereas, the elites are protesting for charges to be dropped, they even correct the charge from rape to “unlawful sexual intercourse with a minor.” Do you wonder if you would get this much support from the Hollywood elites or the media?

With the Casey Anthony case, she was not presumed innocent but she was found NOT GUILTY. The media pundits blame the court system and the 12 jurors that did not run the right script. Could it have been the prosecutor’s inability attempt to get the death penalty? They placed the death penalty and then expect people to disregard death as a possibility in determining the verdict. Please. The prosecutors have massive resources and were still unable to present a solid case. To send her to death on the evidence that was presented would have been a sin. They couldn’t even determine the cause of death.

In 1994, Susan Smith drowned her two sons in a South Carolina lake. She was convicted in July 1995. Just three months later, OJ Simpson would be found not guilty. It appears that our media is eagerly awaiting the next court case so they can justify the flaws within our judicial system. Here we have another infamous mother to add to our list of Susan Smith, Andrea Yates and China Arnold.

HLN’s ratings during this episode boosted from a typical 283,000 people watching to 5.2 million. Apparently, Americans aren’t so glued to the boring TV as we’re led to believe…but I digress.

Actually, our civilian judicial system is something to be proud of. It is a jury of your own peers that must come to a unanimous decision in determining your conviction. It must be beyond a reasonable doubt. This is much better than some bureaucrat or media pundit who has political gains or ratings to decide. The prosecutor did not make the case, simple as that. But the mobocracy wants someone’s death for Caylee Anthony’s, ginned up by the media. To say she was a liar or a narcissist might be an understatement. For her lying and deceitfulness, she did her time.

As our media questions our judicial (trial) system, ask yourself whether the media should be questioned. As they appear to be in the bag for the establishment, convicting and enticing the mob. You could get Fidel Castro, Hugo Chavez, Keith Olbermann or Bill O’Reilly as judge and jury but we don’t. Our judicial system may not be perfect, but being judged by our peers truly makes it the best system in the world.

Loughner Deemed “Not Competent To Stand Trial”

You have absolutely GOT to be kidding me!

I should have known. We have reached a point in our society where nothing makes sense anymore! Up is down, right is wrong, wrong is right, white is black, black is white…. and I could go on and on with analogies. However, that will get us nowhere, really.

I try to be an optimist. I am a Bible believer, so I know the power of prayer. I also know what Scripture says about what will come in what we call “the last days”. Have we reached “the last days?” Well, I do not know for certain, but all signs sure seem to be pointing that way!

Where my faith, knowing what Scripture says will come, and reality clash are my feelings with everything. I am not one to give up in the sense of, “there’s just no point in going on.” I KNOW I have to keep fighting the good fight until my last day comes, whether it is by my death through old age or other occurrences or if it is by way of the rapture of the Church which yes, I do most certainly believe in.

I know that God says, “Vengeance is mine, sayeth the Lord”. (Romans 12:19)

I also believe that there are consequences for our actions. I believe there are certain actions in this life that are punishable by death. Yes, I have Bible Scripture that I use to base this belief on. (Romans 1:28-32 ; Acts 25:10-11 ; Romans 13:1-4) but that is not the point of this article.

Now we have a man who will get away with cold-blooded murder because he is feigning incompetency! Yes, I am calling him a liar, a manipulator, and a game-player playing the system.

This very same man went into court sneering the first couple of times he appeared in court. Now, according to one report I heard on TV, all of a sudden he is “rocking back and forth”.

Please do not get me wrong. I absolutely believe he is a mentally disturbed man. I believe that is quite obvious from his initial actions of murder and attempted murder back in January. I believe there is proof of that from other incidences that have been reported after the attack happened.

Now there will be no justice for Ms. Giffords, the other survivors, and those who were killed that day. Now our tax-paying dollars will have to be used to keep this man alive until the day he dies.

I do not for one minute believe he can be rehabilitated. He has shown absolutely no remorse- even today in court. He is relishing in the fact that he killed people. To me this speaks volumes for his mental well-being, or lack thereof.

So what is the answer? I will be called “inhumane” because I would rather he be put to death.

I will be called selfish, cold, uncaring, un-Christ like for thinking he deserves the death penalty.

I believe justice should be served.

Today that did not happen.

Thankfully this was just the federal case. Maybe the State of Arizona will not be so politically correct!

God help us all.

My continued prayers are with Ms. Giffords, her family and friends, and all the other lives that were affected by this tragedy.
