The official Massachusetts State Police statement on the 5 men and 2 women arrested for trespassing near the largest man-made water reservoir in the U.S. just days after the Boston Marathon bombings is “no comment,” but that’s not the end of the story.

Publicly, MSP cannot legally release the names or other information about the 7 individuals because they haven’t been officially charged with any crimes, despite the state police department’s efforts to reverse that decision by a magistrate judge from the East Hampshire District Court which serves Belchertown, MA where the reservoir is located.

Clerk Randal Smith would not release the date of the judicial review of the clerk’s decision, citing statutes that require information be withheld from the public until a complaint is filed. Radio host and blogger Michael Graham has a bit more information, as provided by MSP Spokesperson David Procopio:

“In summary, the Quabbin case has not advanced at the Belchertown District Court since the original MSP appeal in May. At that time, the Assistant Clerk Magistrate determined that there was probable cause, yet ruled that no complaint would be filed. Subsequent to that finding, because we believe the complaint should issue so that there is a record of a charge against these individuals, we requested judicial review of the clerk’s decision (basically asking that a judge at the court review the case and issue the complaints).

We think it is important to create a record within the judicial system that the individuals were observed trespassing at a critical infrastructure site at an odd hour (around midnight or so) and gave the stated reason that they had professional and academic interest in engineering and wanted to observe the water storage structure.

Since that time, we have made periodic inquires to the court to determine the status of the case. After receiving your inquiry, we made inquiry of the court again today. Today’s inquiry resulted in the court telling us that the case will be heard by the Belchertown District Court Justice on either September 25th or October 2nd. When the appeal is heard, the Justice may make a summary finding or take it under consideration for a future finding.”

Perhaps the intense confidentiality and confusion related to the MSP complaint and any information on the individuals involved can be explained by the “on-going criminal matter” as described in the Freedom of Information Act request response from the Office of Chief Legal Counsel for the Massachusetts State Police. Major media outlets have largely ignored any follow-up on this story, originally reported at CDN in May 2013. Shortly after the trespassing incident, padlocks were cut at an aqueduct in the area that provides drinking water for the greater Boston area.

Mass State Police Unhappy With Clerk Decision

MSP SealThe events following an incident at the Quabbin Reservoir in Belchertown, Mass. have left state police puzzled.

When 5 men and 2 women from Pakistan, Saudi Arabia, and Singapore converged at the reservoir that provides drinking water to the greater Boston area shortly after midnight on May 14, state police thought they would have a slam-dunk trespassing case against the seven individuals. A clerk magistrate, however, put an abrupt halt to those plans which could leave the seven alleged trespassers off-the-hook.

After being detained, interviewed and released by state police, the seven people were to await trespassing charges and a court summons. Local news reports in the days immediately following the incident listed the seven as “arrested,” though state spokesman David Procopio is now saying the group was “detained.”

The clerk’s decision not to charge the group, despite the incident triggering terrorism alerts and the involvement of the FBI, has left state police confused.

“In our view, the clerk’s decision was contrary to our past understanding with the court, specifically, that the continuance without criminal complaints (which is how minor motor vehicle matters are generally handled) is not the resolution in cases involving violations of the Quabbin watershed rules,” said Procopio in an email to MassLive.com.

The FBI and state police have since stated that the 7 individuals who reside in Amherst, Cambridge, Northampton, Sunderland and New York City have no connection to terrorist activity.

Requests to obtain the names and court dates associated with the trespassing incident have gone unanswered by the Massachusetts State Police Chief Legal Counsel Mike Halpin, the East Hampshire District Court, and the records department of the MSP.

The Quabbin Reservoir is the largest man-made water supply in the US and provides clean water to the eastern half of Massachusetts including the Boston area.

Two weeks following the Quabbin trespassing incident, vandals cut padlocks that access the Hultman Aqueduct in Framingham, Mass. The Hultman provides drinking water to the greater Boston area. Authorities say there is no evidence of tampering with the water supply and are calling the broken locks an act of vandalism.

More Suspicious Activity in Boston

NO_trespassingThree padlocks meant to keep trespassers out of the greater Boston water supply in Framingham, Massachusetts were cut and a fourth was damaged, according to State Police. The incident comes just three weeks after 7 foreign nationals were arrested for trespassing at the Quabbin water reserve.

The Hultman Aqueduct carries drinking water to Boston and surrounding towns. Three access hatches about a half mile apart, with clearly visible “No Trespassing” signage, had their locks cut. A fourth lock was damaged but not fully cut. Officials are calling the latest incident “vandalism” with no connection to terrorist activity, though State Police have increased patrols in the area.

The Massachusetts Water Resources Authority released a statement Monday saying, “MWRA’s real-time water quality monitoring shows no change in water quality nor any sign of contamination” at the aqueduct. A similar statement was made shortly after the trespassing arrests in May.

Information regarding the 7 individuals of Middle Eastern decent who were arrested just after midnight May 14th was characterized as “confidential” by a clerk at the East Hampshire District Court in Framingham. The names, charges, and court dates have not been released by authorities, but local news reports say the individuals live in 4 separate Boston suburbs and New York City. How the 7 came to be at the same location in the middle of the night to trespass on Quabbin Water Reserve property remains unclear. Requests for this data and more via a Freedom of Information Act Request, as well as multiple messages for Massachusetts State Police Chief Legal Counsel have not yet been returned.

Questions Remain After 7 Arrested For Trespassing

Shortly after midnight on May 14, 2013, five men and two women, all of Middle Eastern decent, were arrested for trespassing within the boundaries of the Quabbin water reserve just outside Boston, Mass. The seven, who are from Saudi Arabia, Pakistan, and Singapore, are recent chemical engineering grads and “cited their education and career interests” for being at the reserve, according to local news reports. The seven individuals currently live in various Massachusetts towns including Amherst, Cambridge, Sunderland, and Northampton, and one of those arrested lives in New York City.

The Quabbin reserve is in Belchertown, Massachusetts and is one of two sources of the City of Boston’s drinking water. Authorities tested the Quabbin within days of the arrests and discovered no threats to the public’s water supply.

Police have increased patrols in the area as a precaution but say they have found no connection between the seven trespassers and any terror related activity.

Requests from the East Hampshire District Court where the seven will be summonsed for trespassing violations for the names and court dates were denied. A clerk said the cases were “confidential” and deferred all questions to the Massachusetts State Police.

Chief Legal Counsel for the MSP Michael Halpin, did not return phone calls and a Freedom of Information Act request has been sent.

There have been no public statements from the group nor from authorities to explain why 7 chemical engineers from 5 different towns in the Northeast converged on the same location at 12:30 AM on a Tuesday in May to learn about the country’s largest man-made water supply facilities.Arrest

Anwar Al-Awlaki Dead

Americans woke this morning to the news that Anwar Al-Awlaki, the number one Al Qaeda target since the death of Bin Laden, was killed in a CIA predator drone strike Friday. Al-Awlaki has been tied to several terrorist attacks including the Fort Hood shooting in 2009. 
 
Nidel Hasan – the alleged assassin in the Ft. Hood shootings – claimed to have had direct communication with Al-Awlaki before the massacre that killed 14 people and wounded several others. Al-Awlaki, unlike the other high profile targets in the Al Qaeda network, is American born. He became radicalized at an early age and in 2010, President Obama signed an order making him the first American to be named to the “capture or kill” list. 
 
The Yemeni defense department confirmed the kill Friday morning. Yemen’s cooperation in bringing Al-Awlaki to justice has increased dramatically since the rise of civil unrest in the region. The killing strikes a major blow to the terrorist network as Al-Awlaki was considered to be the functional and inspirational leader of Al Qaeda since the death of Osama Bin Laden
 
The legality and constitutionality of the attack that killed Al-Awlaki will now invariably come to the forefront. Unlike Bin Laden and other terrorist leaders, the American born Al-Awlaki had rights guaranteed under the Constitution to Due Process of law. However others will argue that his actions clearly were treasonous, a penalty that at worst warrants death or at least warrants expatriation. 
 
There will be a flurry of arguments from both sides of this issue, but for now, the United States has dealt a severe both to the already shell shocked terrorist network from which it will take a long time to recover.

The Palestinians, The U.N. and Bizarro World

After an eventful week at the United Nations, Palestinian Authority President Mahmud Abbas handed a letter to Secretary General Ban Ki Moon on Friday requesting full membership for the currently non-existent Palestinian State.  The U.N. can, of course, take a long time to “consider” this request before coming to any decision, but the problem here is the principal of the action.

Does the United Nations now have the authority to create nations within disputed borders without due negotiation happening first?  Let’s put it another way:  If a Native American tribe in Kansas suddenly decided it didn’t want to be in the United States any longer, and they wanted the entire state of Kansas for themselves, could they just go to the U.N. and ask to be included as a full member and recognized as an independent country?  The thought is absurd on its face.

How then, can the United Nations and the 100 some odd countries who support this move be so frivolous?  Surely they know that unless and until Israel and the Palestinian Authority come to an agreement on permanent borders and reciprocal recognition of each other that U.N. “legitimacy” is as valuable as a Confederate dollar.

Obviously, they don’t have any authority to do this, but that doesn’t mean they’re not going to try.  The P.A. doesn’t want to negotiate with Israel because Israel wants three things the P.A. is unwilling to give them:

          1.  Recognition of Israel as a Jewish State.

          2.  Jerusalem as an undivided city that is the capital of Israel.

          3.  Secure, defensible borders.

Abbas, himself, said the following when talking about recognizing Israel:

“They talk to us about the Jewish state, but I respond to them with a final answer: We shall not recognize a Jewish state.”

So much for Israel’s point number 1.

Jerusalem has been and will continue to be a major problem.  Both sides claim it as their capital.  Israel doesn’t want to re-divide it.  The Palestinians secretly (or not so secretly) want all of it.  There is no room for compromise here, so the expectation that the two sides will agree on Jerusalem’s status is laughable.

It is more likely that Jerusalem will end up as an internationally maintained city that symbolically serves as the capital for both Israel and Palestine.   Israel will be pressured, grudgingly, into this position.  Palestine will gladly accept it, while complaining publicly about it.  This will give them a foothold and allow them to move further down their stated path of removing the “Jewish scourge” from all of the land.

As to point number 3, the Palestinians don’t care about Israeli security.  They want Israel gone and so they insist on starting with the 1967 borders, thus leaving Israel with a weak point that is only 9 miles across to defend.

The Palestinians, for their part, want all settlement activity by Israel to cease and for the residents that move to their new homes to leave.  They insist on having a Jew-Free Palestine.  Israel, on the other hand, has many non-Jews living inside its borders, some even serving in the government, yet it is Israel that is called racist and apartheid.

The world went to sleep one day not too long ago and woke up in Bizarro World.  In Bizarro World, good is evil, evil is good, everything is backwards and accepted as normal.  In this world, the Palestinians are an oppressed people being systematically evicted from their ancestral homelands by the Nazi Israelis (an oxymoron if there ever was one).

Only in Bizarro World does years of terrorist activity lead to an organization becoming a “respected” partner for peace when their very own charter calls for the destruction of the other “partner”.  Perhaps in Bizarro World, peace only happens when you’re the only party left at the negotiating table.

True peace can never come to the region until both sides learn to accept and respect each other.  It’ll take a miracle for just that to happen.

The Reality Of The Situation In This Country

It appears that we have hit a new low in America. I just read an article via The Blaze that says according to the search engine results over the last couple of days, teenagers do not know who Osama Bin Laden is. I wish I could say this surprises me, but it doesn’t.

I remember in the months before the 2010 mid-term elections there was a “man on the street” style interview with different people and the majority of them interviewed had no idea who anyone in politics was, outside of Barack Obama. There were even people who didn’t know who Joe Biden was.

However, you show them a picture of “The Situation”, and oh my goodness! They knew immediately who he was! In fact, if I remember correctly, one woman even talked about how “hot” he is.

Ironically, I had not a clue who “The Situation” is before that segment! I had to look it up and when I found out he is a reality show star I was appalled!

The reality of the situation in this country is very disturbing.

So the question comes down to this: Who do we have to blame?

The answer to this question is wide and varied, I’m sure.

Obviously, education starts at home. Unfortunately, too many parents see the TV as their babysitter, so from a very young age our children are sat in front of an electronic box spewing mostly garbage. And our children are soaking it up like a sponge!

As they get older they are usually allowed to watch things that children have no business watching. They are being educated alright, but they are being educated about things they shouldn’t know until much later. And though they may be watching TV, or being on the internet as they get a bit older, the thought of checking out the news is foreign to them.

Then there is the education system. They are too busy teaching our children about Earth Day, being “green”, that capitalism is “evil”, new math which makes absolutely no sense whatsoever, and all the other various junk that they have no time for actual education of facts. Therefore, discussing news and world events that are actually relevant are ignored, all the while they shovel in the propaganda that is now classified as “news” but simply serves to further the leftist agenda.

And then there is our current administration. While I must say President Obama gave the best speech of his entire presidency Sunday night, he speaks out of both sides of his mouth. In January of 2009, President Obama said that it was “no longer necessary to kill Osama Bin Laden”. To his credit, he did say at that time that it would be his preference to “capture or kill him”, but it was no longer “necessary”.

Add in the fact that our President refuses to acknowledge that these are terrorists with ties to the Muslim religion, and up until very recently refused to even say it is terrorism, choosing rather to make it all sweet and mushy by  renaming  it “man-made disasters”. It is no wonder why most of this younger generation coming up has no clue what is going on and why killing Osama Bin Laden is news worthy all over the world!

The ever famous quote by poet and philosopher George Santayana should be a lesson to us. “Those who cannot remember the past are condemned to repeat it.”

America, we have allowed our schools to be taken over by the leftist agenda. We have allowed a box to teach our children right from wrong, and the boxes right is more often than not our wrong! If this news story does not wake us up then I don’t know what will. What can we expect? We’ve become so complacent as a nation!

It has been not quite ten years ago that the attack of September 11 happened. Yes, in respect to capturing and killing the man who orchestrated these attacks, 10 years is a very long time for him to be free. However, ten years is nothing in the scope of history. If our kids do not know current history, how in the world do we expect them to know the history of this great nation?

We are indeed doomed to repeat our past if we do not take this seriously immediately and make the necessary changes to prevent this from happening! While there are many bright and beautiful things in our nation’s past, there are also some very dark times as well. Unfortunately, it appears as though we will more than likely repeat the darkest part of our past if things don’t make some drastic changes fast!

America, it’s time to wake up! I don’t know how many more warnings we are going to get!
